Agreement to Terms

By engaging Created By Design for web design and management services, you agree to these Terms of Service. Please read them carefully before starting any project with us.

Our Services

Created By Design provides boutique web design, development, and ongoing website management services. We work collaboratively with clients to create digital experiences tailored to their needs and goals. Service details, timelines, and deliverables are outlined in individual project agreements.

Client Responsibilities

Clients agree to:

• Provide timely feedback and required materials for project completion
• Ensure all content provided is accurate and legally compliant
• Maintain clear and responsive communication throughout the project
• Respect agreed-upon timelines and payment terms

Intellectual Property & Website Ownership

Important: Websites created by Created By Design remain the intellectual property of Created By Design. Clients do not own the website, code, or design files.

Clients are granted a license to use their website for the duration of their active service agreement. This license is contingent upon maintaining an active subscription or service plan with Created By Design.

Domain Names: If Created By Design registers a domain name on behalf of a client, ownership of that domain may be transferred to the client upon request, subject to any outstanding fees being paid.

Subscription & Payment Terms

Our website services operate on a subscription model. To keep your website active and maintained, clients must maintain an active subscription plan. Payment terms are outlined in individual service agreements.

If a subscription is cancelled or payments cease, Created By Design reserves the right to suspend or take down the website. All website files, code, and design elements remain the property of Created By Design.

Project Timelines

We provide estimated timelines for each project based on scope and complexity. Timelines may be adjusted if significant scope changes occur or if client feedback and materials are delayed.

Revisions and Changes

Each project includes a specified number of revision rounds. Additional revisions or significant scope changes beyond the original agreement may incur additional fees, which will be discussed and approved before proceeding.

Termination

Either party may terminate a project with written notice. Clients are responsible for payment for all work completed up to the termination date. Any deposits paid are non-refundable unless otherwise agreed in writing.

Service Discontinuation

If Created By Design discontinues operations, we will provide active clients with at least 60 days' notice.

We will assist with transitioning domain names to clients where applicable and provide necessary documentation. However, website files, code, and designs remain the intellectual property of Created By Design and will not be transferred unless separately negotiated.

Limitation of Liability

Created By Design is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid for the specific service in question.

Warranty

We warrant that our services will be performed professionally and in accordance with industry standards. However, we do not guarantee specific business results, search engine rankings, or conversion rates.

Changes to Terms

We reserve the right to update these Terms of Service. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the new terms.
